Rigathi Gachagua: Blow to DP as court declines to stop Senate from debating impeachment motion

Nairobi – Deputy President Rigathi Gachagua’s bid to stop the impeachment proceedings has suffered a major blow.

Gachagua moved to the High Court seeking interim orders halting the impeachment proceedings at the Senate

In his petition, Gachagua argued that the National Assembly had violated his constitutional rights and that only the court could save him from impeachment.

Gachagua stated that the resolution passed by the National Assembly is invalid on several grounds, and the impeachment motion is replete with general and unsupported allegations.

On Tuesday, October 15, Milimani Law Court presiding judge, Chacha Mwita, declined to grant the orders requested by Gachagua’s legal team.

Justice Mwita said the courts have powers to supervise decisions, including impeachment, made by quasi-judicial bodies such as the National Assembly and the Senate.

In his ruling, Justice Mwita declined to stop impeachment proceedings, stating that the Senate must be allowed to carry out its function and the deputy president could contest the final decision of the senators.

UK Government ‘rejects’ Sunday Igboho’s Yoruba nation petition

The UK Government has reportedly declined the petition submitted by activist, Sunday Igboho calling for support over ‘Yoruba Nation’ Agitation.

This was revealed by Eche Abu-Obe, Spokesperson of the Ministry of Foreign Affairs in a statement in Abuja on Tuesday.

According to Abu-Obe, the UK government does not concern itself with petitions concerning the sovereign affairs of another country hence the petition was not endorsed.

“Following media reports on the petition submitted at No. 10 Downing Street by Mr Sunday Adeyemo popularly known as Sunday Igboho, the British High Commissioner in Abuja was invited to shed light on the issue.

“During the meeting, the High Commissioner noted with concern that the matter was overblown, indicating that the media reports were highly misleading.

“Furthermore, the High Commissioner informed that he was aware of the letter being delivered but added that it was merely an established practice of allowing the delivery of letters and petitions to No 10.

“It was not endorsed by any agency of the UK government nor the UK Parliamentary Petitions Committee.

“The UK government typically does not concern itself with petitions concerning the sovereign affairs of another country,” Abu-Obe said.

He quoted the high commissioner to have informed that such petitions had been rejected by the UK Parliamentary Petitions Committee and the UK Government in the past.

He further agreed to continue liaising with the Ministry of Foreign Affairs as needed, while reiterating the importance of the bilateral relations between the United Kingdom and Nigeria.

Kenya court declines to block Senate vote on deputy president’s impeachment

NAIROBI (Reuters) -Kenya’s high court on Tuesday declined to block this week’s Senate vote on whether to remove Deputy President Rigathi Gachagua from office.

Last week opposition lawmakers voted with allies of President William Ruto in parliament to impeach Gachagua for allegedly stirring ethnic hatred, embezzlement and undermining the government, paving the way for the Senate to consider the issue.

Gachagua has said the impeachment motion was based on falsehoods that constituted a “political lynching”, according to court documents seen by Reuters.

The Senate is due to debate Gachagua’s impeachment on Wednesday and Thursday.
