Court Bars Kano Commission From Conducting LG Election

The Federal High Court sitting in Kano State has disqualified the Chairman and Kano State Independent Electoral Commission (KANSIEC) members from conducting the October 26, 2024 local government election in the state.

 

Justice S.A. Amobede, who presided over the court, delivered the ruling on Monday, in response to a suit filed by Aminu Aliyu Tiga, a member of the opposition All Progressives Congress (APC).

Tiga challenged the KANSIEC chiefs’ eligibility, citing their affiliation with the ruling New Nigeria People’s Party (NNPP) and their failure to meet civil service grade requirements.

In his judgement, Justice Amobede ruled that the chairman and other members of the Commission were unfit for their roles.

“The defendants being card-carrying members of the New Nigeria People’s Party (NNPP) and in partisan politics contrary to Section 197 (1) (b) and Section 200 (1) (a) of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Section 4 of the Kano State Independent Electoral Commission Law 2001, are not qualified to be the Chairman and Members of the Defendant, (KANSIEC),” the judge declared.

Furthermore, the court disqualified Kabir Zakirai, the Secretary of KANSIEC, citing his ineligibility for the position due to his previous civil service rank.

“Kabir Zakirai, not being an officer in the Kano State Civil Service not below the rank of Director before he was appointed Secretary of the Commission, is not qualified to be appointed to the position under Section 14 of the Kano State Independent Electoral Commission Law 2001,” Justice Amobede ruled.

The judgement also invalidated all previous actions taken by the Commission in preparation for the election, including the issuance of election guidelines, screening of candidates, and sale of nomination forms.

“Whatever the Commission did or has done or is doing in preparation for the 2024 Local Government Election in Kano State such as issuance of election guidelines, circulars, screening of candidates, sale of nomination and expression interest forms, whichever and howsoever, are null and void and of no effect whatsoever,” the court stated.

The ruling further prevents the Commission from conducting the local government elections in Kano’s 44 local government areas until qualified persons are appointed to the commission.

“The 1st Defendant (KANSIEC) cannot validly and competently conduct Local Government Election 2024 in respect of 44 Local Governments in Kano State until and unless qualified persons are duly and legally appointed as chairman and members of the commission,” the judge declared.

In addition, the court directed law enforcement agencies to ensure compliance with the ruling, ordering that the defendants be disqualified and removed from their roles immediately. “The defendants are forthwith disqualified and removed from their positions as chairman and members of the Commission,” Justice Amobede ruled.

Kamala Harris has finally phoned Donald Trump to concede the election, hours after her devastating defeat was confirmed.

During their conversation, Harris discussed with Trump the importance of a peaceful transfer of power and being a president for all Americans, a senior Harris aide said, confirming that Harris will deliver remarks in Washington later Wednesday.

‘She discussed the importance of a peaceful transfer of power and being a president for all Americans,’ a senior Harris aide said.

Trump now has 292 electoral votes to Harris’ 224. It takes 270 to win the presidency.

Trump is the first president in over 130 years and only the second in history to win a non-consecutive second term.

Exit polls show his victory came after he made gains with nearly every voting bloc he lost in the 2020 election and put together a coalition of multi-ethnic working-class voters.

A statement by Special Adviser to the President (Information & Strategy), Bayo Onanuga on Wednesday, said President Tinubu looks forward to strengthening the relations between Nigeria and the United States amid the complex challenges and opportunities of the contemporary world.

Donald Trump claimed victory on Wednesday and pledged to “heal” the country Wednesday as results put him on the verge of beating Kamala Harris in a stunning White House comeback.

President Tinubu says, “Together, we can foster economic cooperation, promote peace, and address global challenges that affect our citizens.”

According to President Tinubu, Trump’s victory reflects the trust and confidence the American people have placed in his leadership. He congratulates them on their commitment to democracy.

President Tinubu believes that, given President Trump’s experience as the 45th president of the United States from 2017 to 2021, his return to the White House as the 47th president will usher in an era of earnest, beneficial, and reciprocal economic and development partnerships between Africa and the United States.

Acknowledging the United States’ influence, power, and position in determining the trend and course of global events, the Nigerian leader trusts that President Trump will bring the world closer to peace and prosperity.

President Bola Ahmed Tinubu has appointed Abdulrazak Yusuf Tukur as National Commissioner for the Independent National Electoral Commission, representing the North West.

Tinubu also nominated a lawyer, Saseyi Feyijimi Ibiyemi, to replace the late Resident Electoral Commissioner of Ogun State.

Bayo Onanuga, Special Adviser to the President on Information and Strategy in a statement said, Tukur, 59, has Bachelor of Arts from Bayero University, a postgraduate diploma in Economics from Bradford University, England and a Master of Arts from Leeds University, also in England.

He began working for INEC in 1999 as assistant chief administrative officer and rose to become the director of Electoral Operations and Logistics.

Tukur’s appointment is subject to confirmation by the Senate.

Onanuga also said if cleared by the Senate, Ibiyemi will replace another lawyer, ‘Niyi Ijalaye, who died in August while serving as the resident electoral commissioner in Ogun State.

Ibiyemi, 58, who hails from Ilaje in Ondo State, is currently the Administrative Secretary of INEC in Lagos State.

She graduated from Obafemi Awolowo University in 1987 and was called to the bar in 1988.
