Court declines EFCC's request to arraign Yahaya Bello without his counsel

The Federal High Court, Abuja, on Friday, adjourned sitting on the alleged N80bn fraud charge against the immediate past Governor of Kogi State, Yahaya Bello, to December 13, 2024 for possible arraignment.

Justice Emeka Nwite adjourned the sitting in the interest of fair hearing, noting that the matter had been originally adjourned to January 21, 2025.

When the matter was called on Friday, the former Governor was asked why his lawyers were not in court.

He said he was only informed of the sitting late Thursday night and so could not contact his lawyers to be at the court.

The EFCC Counsel, Kemi Pinheiro, SAN, insisted that the Defendant’s plea be taken as What the law requires is the presence of the Defendant, not the presence of his lawyers.

Delivering a short ruling, Justice Nwite said, “The matter came up on the 30th of October 2024 but was adjourned to 21st January 2025.

From the statement of the Defendant, his Lawyers are not aware of today’s date.

Therefore In the interest of fair hearing, he will not proceed for arraignment. He ordered the prosecution to serve the Defendant’s Lawyer with the application for abridgment of time.

The Court suggested December 13, 2024 for the Motion for abridgment.

However, the EFCC counsel applied that the date be for motion and possible arraignment and that the Court should order that the defendant should remain in EFCC custody till the 13th of December when he is to appear before the Court. The judge agreed and so ordered .

Former governor Bello is already in EFCC custody over a fresh N110bn charge before Justice Maryann Anenih of the Federal Capital Territory High Court.

The ruling on his bail application was adjourned to December 10, while he and his Co-Defendants were to remain in the Commission’s custody till that date.

As IGP Re-echoes Directive To Mop Up Arms.

The Nigeria Police Force in its unyielding resolution and unwavering commitment to ensuring the safety and security of all citizens, continues to work tirelessly to prevent and combat all forms of crime and criminality.

These relentless efforts are paying off, as the Force has successfully made the arrest of five (5) suspects involved in trans-border gun running. The suspects identified as Adamu Noma ‘m’, Matthew Audu ‘m’, Andrew Poyi ‘m’, Aminu Sani ‘m’, and Aminu Talha ‘m’ were apprehended by the operatives of the FID-IRT on the 18th of November, 2024.

Upon arrest and conducted search, 10 locally fabricated Ak-47 rifles, 5 Isreali Ak-47 rifles, 1 revolver pistol, 1 pump action rifle, 20 rounds of Ak-47 ammunition, and 1 welding machine for fabrication of rifles were recovered from the suspect.

These feats, and several more recorded by police operatives across the country are indications of the steadfastness and commitment of the current police leadership to decimate and subdue criminal activities and insecurity in general in the country.

The Inspector-General of Police, IGP Kayode Adeolu Egbetokun, PhD., NPM., has re-echoed his directive to operatives of the Force, particularly, tactical units, to mop up every illegal arms and ammunition, and see to the total dismantling of local manufacturers of illicit arms and ammunition and dangerous weapons by all means.

A Federal High Court in Abuja, on Friday, discharged and acquitted no fewer than 50 persons alleged to be members of the proscribed Indigenous People of Biafra (IPOB) of allegations bordering on terrorism.

Justice James Omotosho, in a judgment, held that the Nigerian Police Force failed, in its entirety, to established a prima facie case against the 50 defendants, including four women.

Akelicious reports that Justice Omotosho, who upheld the no-case submission of the defendants, said that the prosecution failed to adduce any credible evidence, linking the defendants with the allegations they were charged for.

The judge consequently struck out the three-count charge preferred against the defendants.

Counsel to the Defendants, Ifeanyi Ojiofor expressed satisfaction with the decision of the court.

The Inspector-General (I-G) of Police had, in the charge marked: FHC/ABJ/CR/8/2024, sued the 50 defendants. They were alleged to have assembled themselves inside 911 truck with Reg No. XA-139 BDN, and engaging themselves in a meeting all about, and in connection with an act of terrorism.

Besides, they were alleged to have in their custody 48 Black Caps, 25 Red Caps, 6 Orange Colour Caps, and all were designed in IPOB emblem with various degrees of charms otherwise known as juju, “which you admitted to have possessed the spiritual power of disappearing while carrying out your terrorist transaction.
