Supreme Court quashes Garnishee Order against CBN, says Police, SARS, not MDAs

The Supreme Court of Nigeria has set aside a garnishee order issued against the Central Bank of Nigeria, CBN, dismissing proceedings initiated by Inalegwu Frankline Ochife in a legal battle that has spanned years.
Delivering the lead judgment in the appeal suit number SC/CV/268/2021, Justice Habeeb Adewale Olurmuyiwa Abiru held that the lower courts had erred in their assessment of the case.
The dispute originated from an October 10, 2018 judgment of the Federal High Court in Abuja, which awarded Ochife N50 million in damages against the Inspector General of Police, the Commissioner of Police, FCT, and the Officer in Charge of the Intelligence Response Team, Special Anti-Robbery Squad, SARS.
Seeking to enforce the judgment, Ochife initiated garnishee proceedings to attach funds from the judgment debtors’ accounts under the Treasury Single Account, TSA, held by the CBN.
On December 10, 2018, the Federal High Court issued a Garnishee Order Nisi directing the CBN to deduct N50 million from the alleged accounts of the judgment debtors.
The CBN, however, filed an affidavit to show cause, asserting that it did not hold any accounts in the names of the judgment debtors and was therefore unable to comply with the order.
Despite this, the Federal High Court made the Garnishee Order Absolute on January 21, 2019, prompting the CBN to appeal the decision.
The Court of Appeal, in its ruling on December 4, 2020, dismissed the CBN’s appeal, reasoning that since the judgment debtors were government agencies, their funds must be held under the TSA policy.
Relying on Section 124 of the Evidence Act, the appellate court took judicial notice of the TSA framework and upheld the garnishee proceedings.
Dissatisfied, the CBN took the matter to the Supreme Court, arguing that the proceedings were invalid due to the judgment creditors’ failure to obtain the consent of the Attorney General of the Federation, AGF, as required by Section 84 of the Sheriffs and Civil Process Act, SCPA.
The apex court ruled in favour of the CBN, determining that the Inspector General of Police, the Commissioner of Police, FCT, and the Officer in Charge of SARS are not Ministries, Departments, or Agencies, MDAs, of the Federal Government and, therefore, do not fall under the TSA framework.
Justice Abiru, delivering the lead judgment, criticised the lower court’s decision as “perverse,” stating that it relied on irrelevant considerations and failed to assess the evidence properly.
The Supreme Court held that the first respondent failed to provide specific details of the accounts allegedly maintained by the judgment debtors at the CBN.
The Supreme Court set aside the Court of Appeal’s judgment, dismissed the garnishee proceedings, and discharged the CBN from any liability in the matter.
Each party was ordered to bear its own costs.
While the majority judgment refrained from making a direct ruling on the applicability of Section 84, it did not render the provision obsolete.

Deji Adeyanju, a prominent human rights lawyer and senior partner at Deji Adeyanju & Partners, has congratulated High Chief (Dr.) Government Oweizide Ekpemupolo, popularly known as Tompolo, on his 54th birthday, lauding him as a transformative figure in the Niger Delta’s quest for justice and development.
In a statement on Sunday, Adeyanju described Tompolo as the “great lion of the Niger Delta” and the “Ibe-Ebidouwei of Ijaw Nation,” recognizing his decades-long advocacy for the region’s rights. He credited Tompolo’s efforts with securing the 13% derivation fund from the Federal Government, a milestone that has bolstered economic development and empowerment in the Niger Delta.
Adeyanju also highlighted Tompolo’s role in protecting Nigeria’s oil and gas assets through Tantita Security Services, a firm founded by Tompolo. The organization has been instrumental in curbing vandalism, contributing to the nation’s economic stability. Additionally, Adeyanju noted that Tompolo’s advocacy has helped reduce environmental pollution in the region, though challenges remain.
“His monumental contributions to Nigeria’s economic development will forever be etched in history,” Adeyanju said. He wished Tompolo continued strength and resilience in his service to the nation and humanity.
Adeyanju credited Tompolo with contributing to the establishment of the Niger Delta Development Commission (NDDC), stating that their advocacy led to significant infrastructure improvements, including the construction of roads, provision of motorable routes, and access to drinking water in numerous Niger Delta communities.
He further noted that the relative peace the region enjoys today would not have been possible without Tompolo and other agitators choosing to lay down their arms. Adeyanju attributed the creation of the Presidential Amnesty Programme, which has empowered millions of Niger Delta youths through skills acquisition and development initiatives, to the impact of Tompolo and other agitators’ actions.
Tompolo’s work has spurred significant development across Niger Delta communities, earning him widespread recognition as a defender of the Ijaw nation. Adeyanju extended his wishes for a long, healthy, and impactful life, celebrating Tompolo’s enduring legacy as an emancipator of his people.
